What is stopping a freelance worker from tax evasion if they and the client dont file a 1099?

... the questions I foresee being hit with is how can you tax it? I am intend to argue that it will be tax like freelance work if they are independent or through the agency they are associated with. With the freelance method I understand it involves 1099s form. What I would like to know is what if the freelance worker and client do not file a 1099 how would it get found out that they are tax evading?

It depends first on what country. In general a tax does not exist until one is assessed, and an individual is not required to report payment for a service as if it were income for somebody.
