Assume that LW did provide the Timothy hay to Mary at a price of $4.50 per kilogram however before delivery the Timothy hay was incorrectly left exposed to air for 48 hours in LW’s warehouse causing it to become contaminated with mould. LW did not detect the problem, and the contaminated Timothy hay was packaged and sent to Mary. Mary fed the hay to her rabbits and because of the mould the rabbits became very sick and 10 of them died. Mary had contracted to sell these rabbits to buyers and would have made a profit of $300 on each of them. Does LW have any liability to Mary in this case?
