We rented out a house to a family. the deal is you have from the first of every month to the fifth. every day after that has a 100 dollar penalty. every month since October, the tenants have claimed they will pay and make us go drive to collect the money only to find it was a wild goose chase as the person not money were present. they never call back, rarely text back and never give a heads up before due dates. what can we do and please don't just say 'kick them out' because we have a contract and it's complicated

If you have a contract that's even better, that right there makes it easy to kick them out. If they aren't following the contract that they had to sign. Then you can take it to court. People who don't pay don't deserve your sympathy. Especially if you are providing a home for them. Alternatively you could threaten them with eviction, but if they don't get the memo. What can you do??? You aren't going to house them for free and payments must be on time.
the thing is we can't threaten any of that because regardless of how much false information they give or how many fruitless trips they send us on, they eventually give the money before the deadline ends. this is the first time they've officially passed the due date
