A friend deceived me out of $5K. He refused to pay me back so I suited him in the small claim court. Before the hearing date, he wanted to settle out of court and there was a payment plan put in place. After five payments he defaulted and said he couldn't pay any more because he is sick and he is going to file personal bankruptcy. I am ready to file the default judgement against him. My question is what this judgement would do to him if he file bankruptcy? Would this judgment be discharged in the bankruptcy court? I know he has life insurance and he is an very old man. If he dies would I be able to collect money from his life insurance? I also reported him to the Police for fraud and he admitted his wrongdoing. I dropped the case when I agreed to settle in the civil court on condition that he pays me on time per settlement schedule. Can I reopen the criminal case against him? Thanks.
