I filed for chapter 7 bankruptcy in november of 2015 and was officially discharged in feb 2016. At the time i had a car loan totaling $25,000 and I had payed about $17,000 off already.
I had stop making payments. It is now sept 2016, 7 months after my last payment and the lenders have tried to repossess my car, but still have not been able to get it. (I keep in private garage). I still have it and have been driving it.
I was planning on voluntarily surrendering the car once I had enough money to buy another car (used and inexpensive). I am a little worried that I will have more debt for the months I missed the payments from feb-current time.
What is going to happen? Is it illegal to have the car this long without making payments? Also, can the finance company sue me and take my annual tax refunds? I don't make that much, I only make about $20,000 a year with 2 dependents, I an a small business owner, and the tax return helps out every year.
