I am a server. I was paid properly for a few months regarding the way my credit card tips and $3.00/hour were reported. On the other hand, quite a few months my boss would "pay me under the table" (my checks seemed to decrease about $20 when she did this), but she would still take out taxes for my credit card tips just not the $3.00/hour supposedly. i would work anywhere from 45-80 hours every two week period. my credit card tips would be around $700 and i would only receive anywhere from $10-$40 every two week period. after i quit this past weekend she admitted in a text that she did in fact take out 15% (I m pretty sure it was more) of my credit card tips from my check to pay for the taxes reported under the restaurant.

She also threatened me with a 1099 tax form because i never claimed cash tips she says, but she deleted EVERY cash transaction at the end of every night to save her restaurant from paying taxes on that income.

what can i do about this without getting myself in any trouble?

i payed plenty money in taxes that was never reported under me. i could have had a higher refund (especially since i have a child i claimed). i already filed taxes with my w-2 this year. do i have the option to do anything?
