Is it legal for a university to make a student retake a course if the course isn't equivalent to the one the that student failed? (note: the course is still being offered by the university)

Universities develop their own list of courses required for each major. Many required course requirements can be met with any one of several different courses but the university has some flexibility in this regard. So the short answer is yes. You don't say why the university wants you to take a different course but statistically students tend to get the same grade in failed classes the second time they take the same class.
