Following a cycle accident for which I was unfortunately clearly at fault, a girl I collided into suffered a leg and ankle injury. She is looking to claim damages and expenses from me but due to my own careless oversight I didn’t have cycle insurance.
With not having any insurance cover, I have obviously not been able to afford to pay her up front, so she is suing me for quite substantial damages for her personal injuries and expenses.
I know that by suing me in court, there will also be court cost and also her legal expenses to pay which I believe could significantly increase the amount I will have to pay her.
I’m not sure how all of this works, will she first be just suing me for her personal injuries and personal expenses? Then once she has a judgement on that, I’m wondering if she will then need to sue me again for her legal and court costs separately, or are they added to the final total that I will have to pay for the judgment? I’m hoping that I will be able to pay in installments?
Thank you for your information, I wasn't ware that court fees worked like that. I've since also been told that as this collision was my fault and the girl is suing me for personal damages, she has full control of this. I'm told that once she has me sued, if I don't pay her she can then apply for a wages garnishment against me and even a seizure of assets. Can anyone confirm this?
