eBay closed/restricted my account. Before doing so I sold an item in which had an open case. I verified with them and PayPal to ensure that if i sent out the item my pending funds would still be issued to me. They both insured me i was secured and all i needed was a valid tracking number. I trusted the information, and shipped the item. The next day i received an email stating that they closed the case and sided with the buyer, issuing them a full refund. I now have no funds and no item. I quickly called paypal who transferred me to ebay. After several transfers through the ebay department and an hour later their conclusion was that i was misinformed and that there was nothing they can do. I have the buyers personal info paypal email, address and phone number. Even after i ask them nicely to return the item if they don't follow through is there a way to legally go after them? There has to be a law of theft, right?

Yh there probably will be a law for it cause its unjust that it happened to you. Your best option is to seek legal advice..perhaps go for a free advice/consultation session with a legal professionalist and they'll give you better answers. Ive seen similar stuff to do with debts needing to be repaid by like friends ... so im guessing theres something you could do. You might need to instruct a lawyer though to go about doing it the right way. Theyll give the other person 21 days to reply... and then a 7 day warning..and if nothing is heard back as response theyll issue a court proceeding which willl be a lot of money and might not be worth it for the product.
