Is it fair that a child that is born in the United States to a Japanese mother has a Japanese passport can not be deported under Japanese law to the United States? This would even be the case if she were taken/retained in Japan in violation of a US child custody order.

That sounds very strange to me. A child is "normally" a citizen of the country in which he is born. Some countries accept dual citizenship (not sure if the US does) but in a lot of cases the child who has both must decide by age 21 which of the 2 he or she will retain. Perhaps you should ask that from a lawyer.
