Every married couple needs to be granted
a divorce in a court of law. It doesn't matter if
how much time has lapsed since you've seen
each other.
Nobody can have an automatic divorce.

As per Indian Penal Code for Grounds for divorce. there is one grounds that couple is separately live life more than 7 years.

On this ground u can apply for divorce.
