There is nothing fair about everybody being forced to do things the same way when half or less want it that way. For example in USA the people are about evenly divided on abortion, but the lawmakers can't cope with "evenly divided". Everybody must obey one law. So half the people are coerced to do something against their beliefs.
There are various methods of holding an election, of which some methods are deemed fairer than others. For instance, Northern Ireland held an Assembly Election in March of this year that saw the Democratic Unionist Party poll 1,120 votes ahead of Sinn Fein and as a result saw them win one seat more than Sinn Fein.
Similarily at the last UK general election in 2015, the Conservatives had a 6% lead over Labour and won 99 more seats than Labour leading to suggestions that the UK election was not fair
