Read the paperwork you signed to see if it says they are not responsible. If it does youre out of luck go buy another one. If there is no suck paperwork file a formal complaint withe the state department that licenses hospitals if they refuse to get you another one after you ask nicely.

Save the piece of paper that lists your personal property that they took away from you when you entered the hospital. If the phone is listed on it because that piece of paper is gold. Its proof you had the phone..
