It depends on how your case is handled. If your lawyer will agree to an out of the court settlement, the process will be short because both parties will agree to the amount your lawyer will ask from them. However, if you pursue a personal injury lawsuit, you may not be able to get the settlement immediately. My friend was legally represented by a lawyer from kenallenlaw.com and the settlement process was quick. Find a lawyer in your locality who can defend your rights in the fastest and effective way.
It seems like the accident happened a few years back. I am confused, after the accident, did you get compensated for the damages? If not, I am not sure if you can actually make a claim since there are limitations as to until when you can file a claim, but this depends on the state you are in. I would advise you to seek the help of a lawyer from theledgerlawfirm.com to have a better representation and be compensated. Dealing with these things can be very complicated, not unless you have someone who knows how to do it.
That usually depends on the right evidences and most of all, your lawyer. If your case has a clear evidence on the person at fault, most likely the case will be settled in no time. Moreover, if you have a good lawyer who could represent and defend you all throughout the entire settlement process, well and good. Mine was settled months and didn't last for a year. The evidences were clear that the person who rear ended my car was at fault. Good thing, my lawyer has his skills and knowledge to pull the case out. He was a lawyer from californiaattorneyhelp.com.
