Landlord is suing us for water damage. (They agree it wasn't our fault, but say we should have noticed and reported it. It was behind the closet door in our 13 yr olds bedroom) The total bill is $3500. They are suing us for $3500 plus $1000 in lawyer fees. However, they turned in and received a payment from the insurance company only paying a $500 deductible. Their lawyer told me in an email about the deductible but won't tell me how much $$$ they received from insurance, or who their insurance company is, or the name of the company who did the repair work. They are also keeping our $700 deposit for "excesses lawn mower wheel marks on fence," "not properly cleaning oven," etc. I believe they turned in several items on their home insurance and received more then the $3500 they are suing us for. So I would like to have hard evidence to show the judge how much they have already been paid out and that they are trying to collect twice for the exact same damages. Is a private detective my only option? Its not insurance fraud, I've already called the hotline. They would have had to collect from me 1st and the insurance 2nd to make it insurance fraud.
