Where is employer located? This could be discrimination on the basis of "family status" in Ontario (Canada) and at least some other provincial jurisdictions as well as federally. Courts and human rights tribunals in these jurisdictions continue to expand the scope of family status as a ground under human rights legislation. The real question is whether the complaint would be worth pursuing. Would require more facts to answer that one.
As employer is located in Massachusetts, I cannot advise you. I am a Canadian employment lawyer licensed to practice law in Ontario. However, for what it's worth, absent proof of discrimination based on race, color, etc., if this had occurred in Ontario, the maximum claim you would have if you could prove that the contract had in fact been formed (as it appears it was) would be the equivalent of one week's pay. Hardly worth the trouble. Good luck.
The employer is in Massachusetts. Let me give more details..I applied for a job on line, was contacted by a placement agency who performed an online interview and then scheduled an interview with the company for a Monday. Wednesday I was offered the position which I had accepted. The woman from the placement agency sent me all the paperwork via email..tax forms, direct deposit forms, the acceptance letter etc.. all which I had completed and returned. Friday of the same week, the woman at the placement agency personally text me on her cell phone and said "good luck" Monday, which was my start date..one week exactly after the interview. Approximately one hour after the first text, she text me again and asked me if I was available to talk..I said yes. She and the other woman from human resources..(from the placement agency) contacted me by phone and apologized to me stating that I no longer had the job. A woman who had left the company on her own hated her new position with another company so she came crying back and they felt they needed to take her back because her husband was high up in the company. I was also told by this woman that she was to go directly to the company Monday and find out exactly what was going on. I had contacted her pertaining to her so-called visit and she said that she didn't believe that she's had the opportunity to follow up on the situation. I was devastated that the position was rescinded and do not intend to persue in any way, but for self gratification, was curious if this was legal or considered discrimination.
