Hello, In 2013 an 85 year old man pulled out in front of oncoming traffic when being impatient at a stop sign and I ended up hitting his vehicle. I did not have insurance at the time and of course the accident was deemed his fault. I never went to court about it either, all that happened after the accident was I got a very small check from his insurance company for the loss of my vehicle.

Today I was trying to get insurance on my new truck and the insurance company told me it was going to take $200 to get it started and that I had to pay $115 every month ( a $45 jump from the last time I was paying insurance) which is all fine but the problem I am having is this. They told me I was "flagged" for not having insurance during my car accident last year which I guess I can understand and what not since insurance is a big deal but its what they told me after that that is bugging me. They told me that if I get into another car accident NO MATTER WHAT the situation It will automatically be deemed as my fault. Yupp, they told me that if a drunk driver were to hit me while I was parked at a traffic light the accident would be my fault and I would have fines and jail time. This does not seem to be legal at all and if it is What the hell?!?! I get it if I cause the accident I may have additional problems because of me now having insurance last time but if I get hit by anyone at anytime it is automatically my fault?? Someone please explain this to me.
