... room, the officer did not tell me i was in custody, under arrest, or anything else. My phone went off an i showed him. He said to give it to him and i said "no sir this is my property and you are not allowed to have it. When i put it in my pocket he jumped on me and put his hand on my throat. Then, picked me up and threw me down. Now theyre trying to charge me for the original charge and resisting arrest when that was the only problem we had. Should i push for charges to be dropped and get a settlement? If so how, and how much should i ask for. I got minor bruises but they threw me into a wall and broke the wall
Government - Okay, this is a long one. I got caught doing something (thats not the problem). In the?

Call a lawyer! They must tell you that you are under arrest and you not giving up your phone is not resisting arrest. He should have never been so rough with you! I would explain what happen make sure to have pictures of the bruises and write in full detail down with dates and times. This way you can remember everything fully. Sounds like to me an officer abusing his power!
Yes you can call a Lawyer but it depends on what the officer stopped you for in the first place. When you are stopped by the police everything that happens to you they must see, everything that is in your possession they can look at and even take in for evidence. The right thing to do was let the officer take your phone he can not do anything harmful to it if he does you can press charges but because you said no and put it away he has the right arrest you for resting arrest, and maybe even obstructing of justice.
