...  facet on the hot water heater flooded the apartment by the way there was no water in the toilet the landloard is trying to say im responsible has failed to return any money what is my defense in court ?????

just exactley what you said here that the water heater flooded your apt there was no water in the tiolet this is on them.Youshould go to the landlord tenant web site on line go through there it should tell you what to do next tell the judge the same thing you told me sounds like a faulty water heater.
