It is a complex matter, with the land on the other side of my border being an alleyway; but one which is owned by the three properties behind. They cannot annexe it to their gardens however, as it was designed as communal rear access and an emergency exit. It is complicated further by a fourth property at the end of the alleyway being entitled access, but with no title.
The three properties with title do not want me to include access to the alleyway in my new fence. Against them I wish to argue that it should be kept clear (which it is not) of obstruction, and that the boarded up and sealed entrance should be cleared, and furnished with a gate at the very least to facilitate access in an emergency.
I guess the whole scenario may be too complicated to discuss on here, but I thought I might try a few bullet questions to see what comes back.
I am angry that these people are so petty, and that they are trying to intimidate not only me; but also the elderly single lady in the property with access but no title; who most definitely has rights which are being flagrantly violated.
I accept that I am not entitled access without permission, but wanted to include a gate in my fence to facilitate maintenance of my fence and overhanging trees when that permission is granted. I assumed that i could obtain this permission from the lady with access only, without having to seek same from any or all of the three owners with title, as; given their attitude... I would rather not be servile to any of them. That permission to access element is another I would like to clarify definitively. Really, the whole thing is becoming a `can of worms`, and it is so futile,,, but there needs to be some sort of resolution... as right now... I have no rear fence... and they are talking of building one inside my line. i.e. in the alleyway... which i believe they cannot do as it creates yet another obstruction... all of which i believe are illegal.
It would help if the lady with access would come down definitely on my side, but although i have said I will stand up for her; she is afraid of upsetting people.
