I was parked in parking spot with a car parked infront of me , the car infront drive out of her spot and I drove straight out through her spot instead of me reversing back. She was well out of her pot and while I was driving forward she started to reverse back because there was someone waiting in there car in the middle of the lot , I had my lights on and was in full view if she used her mirrors and checked her blind spots , I didn't beep because I was in shock but as soon as I saw her reverse lights I stopped moving and she reversed into me , I need a new headlight and there's some paint damage under the light, when I gave the girl the estimate I got from the garage she said she didn't think there was that much damage to my car and I think she might refuse to pay, she also doesn't want to go through insurance , is it her fault? Can she blame me for any of this?

Im not sure it depends where you are and law where the accident took place. For example im from europe and in my country when there is no proof that she reversed and hit the front of your car with the back of hers it is always the one at the back who takes the blame i.e. you. However if there are witnesses you will manage to escape it although it is not always the case.
I think it is best to check with how the law works before getting into further trouble mate

You are at fault as you didn't reverse out as you should have. Any money she pays is up to her, she has zero obligation to pay anything and in fact you should be paying for damage to her vehicle. How on Earth was she supposed to anticipate that you would drive into the back of her parking space, YOU should have waited to make sure the area was clear before moving forward into her space.
Again, it's your fault both morally and legally speaking and she doesn't owe you a penny, quite the reverse in fact.
She has already left the spot, it was clear for me to take hers, I didn't have to reverse out as she had was gone so it was a free spot, she reversed back into the spot without checking it was clear or using her mirrors to check if the space was still free, she had just presumed it was clear
Sorry but if it was a designated parking area, that is the spaces are lined off, then road laws apply. The line cannot be crossed by a vehicle and when you decided to take a short cut and cross it you broke the, very minor, law. The other driver has the right of way.
That said and after reading your comment I must say that some of the fault lies with her for not taking due care and attention when reversing.
Essentially it's your word against hers and if you take it to court you are liable to lose. I hate to say it but your best bet is to take the most she will offer and accept it. Put it down to a learning experience albeit a slightly expensive one.
We got a call from police, she told them she can't afford to pay the price that she will need to go through insurance so we have to call them tomorrow morning and explain situation , will keep you updated
Thanks for the reply, was definetly her fault she admitted it when it happend and gave me her contact details to let me know prices, when she found out the damage was more then she expected then she started making excuses saying we didn't see each, I seen her reversing into me and stopped which was my only choice as she was driving too fast , the only thing I could have done was beep but at the time I froze , she had left the spot and was clear that's why I drove in, she didn't check that it was still clear when she reversed back, waiting on her to call me back to see what she says, hopefully some good news
