My husband and I want to make sure that if anything ever happens to me that our daughter (not his daughter by blood) is never taken from him and our son we have together.

yes if he hasn't been a real father to the child. your also aloud to change the child's last name because he hasn't been around for more than 4 years my mum changed my last name when he left us but now its just me and my mum and honorstly I feel so much safer good luck(;
