this shipping company told us that their trailer broke and was being fixed. we constantly called them 2 weeks straight for a status and they said they don't know when itll be fixed. we suspected that they lost our merchandise and was not telling us the truth. sometimes, when we called or emailed, we would get no response. 2 weeks later (today) i go on their website and they post a apology notice saying that they no longer can operate due to difficulties with economy, etc. they've said over the phone that they would refund us/ take responsibility for the shipment. I have called them several times already and no one answers. We think they might have ran away or shut down. Will i be able to sue them and if not, what can i do. Please provide some advice. thank you.
