A pedestrian is waiting between 2 cars to cross a road (the gap measures around 50.-60 foot) A car?

... pulls into that gap to allow traffic through in the opposite direction. When the car pulls into that gap they hit the pedestrian onto bonnet, into windscreen and on to a parked car also causing damage to the parked vehicle. Who is at fault? Should the pedestrian havewaited on the pavement or was the driver not paying enough attention. The pedestrian didn't survive
